Moonlight Safe Rides – Terms of Service

Moonlight Safe Rides – Terms of Service*Last updated: 05/29/2025

Welcome to Moonlight Safe Rides!

These Terms & Conditions outline the rules and expectations for using our ride services. By booking a ride with us, you’re agreeing to everything laid out below. If anything is unclear, feel free to contact us before booking.

1. Who We Serve

Who we’re here for — and who’s welcome

Moonlight Safe Rides is a community-driven ride service offering safe, respectful, late-night transportation in the greater Houston area. Our mission is to create a welcoming option for anyone who feels vulnerable traveling at night — especially women, LGBTQIA+ individuals, and others who are often underserved or overlooked by mainstream ride services.

While our service is designed with these communities in mind, we do not discriminate based on gender, sexual orientation, identity, race, religion, age, disability, or any other protected category. We ask that all riders respect the purpose and values of this service by behaving with kindness and consideration toward drivers and fellow passengers.

Knowingly misrepresenting your identity or intent, or behaving in a way that contradicts our safety mission, may result in refusal of service and forfeiture of any refund.

2. Ride Types & Booking

Picking the right ride — so your trip goes smoothly

We offer three types of bookings (please choose the correct service — if the wrong ride type is booked, your ride may be denied and full payment still charged):

  • Ride for Me - Book a ride for yourself and up to 3 guests. Only the primary rider needs to provide contact information; however, the entire group is expected to follow our rider expectations. If any guest violates those expectations, the ride may be ended early or the whole group may be refused future service. If this ride is booked for someone else, service may be denied and full payment still charged.

  • Ride for Others - The person booking accepts full financial responsibility, and acknowledges that the ride may be ended early with no refund, and future bookings may be refused, if the rider or their guests do not meet our rider expectations. Rides booked using this option must meet the same conduct standards as direct riders. If the wrong ride type is booked, service may be denied and full payment still charged.

  • Ride with Others (Shared Ride) – Discounted ride option. The discounted rate only applies if we are able to match you with another rider going a similar direction. If a match isn’t found, your booking will be converted to a standard ride and charged at the standard rate. You’ll be notified before confirmation. Booking this service without being matched with another rider does not guarantee a discounted rate.

Booking Requirements:

We ask that bookings be made at least 48 hours in advance. When booking, you agree to:

  • Provide accurate pickup and drop-off details.

  • Be at the pickup location at your scheduled time.

  • Communicate promptly if your plans change.

We aim to arrive 5 minutes before your scheduled pickup. If you’re not at the pickup spot within 5 minutes after your scheduled time, your ride may be canceled and charged in full (this equals 10 minutes total wait time).

All stops must be requested in advance. No last-minute stops will be accommodated. Exceeding stop times or unscheduled detours may result in early ride termination.

If the wrong form is used or ride expectations are not met, we reserve the right to refuse service. Full payment will still be charged in such cases.

7. Accessibility

Making sure you can ride comfortably

Our vehicle is a compact Nissan Versa, which may not accommodate certain mobility aids or equipment. Please contact us prior to booking if you have accessibility needs so we can discuss whether we can safely accommodate your ride.

8. Liability

What we’re responsible for — and what you accept

While we strive to provide a smooth experience, we are not responsible for:

  • Items lost or left behind (we’ll do our best to return them; a $20 fee applies for returned lost items).

  • Delays caused by traffic, weather, or other uncontrollable factors.

9. Recording & Monitoring

Keeping everyone safe with video

Vehicles may be equipped with dash cams that record audio and video. By entering the vehicle, you

consent to being recorded. Recordings are used only for safety, training, or dispute resolution purposes and are handled according to our Privacy Policy.

10. Privacy

How we protect your info

Your privacy matters. We will never sell or share your information without your permission. See our Privacy Policy for full details.

11. Emergencies & Delays

When things don’t go as planned

Rides may be delayed, rescheduled, or canceled due to weather, emergencies, or safety concerns.

We will notify you as soon as possible.

If we can’t reach you during pickup, the ride may be treated as a no-show.

We reserve the right to refuse service at our discretion for safety or policy reasons.

12. User Accounts

Keeping your account secure

If you create an account on our site, you are responsible for keeping your login info secure. You agree to use your account only for lawful purposes and to provide accurate, up-to-date information.

14. User-Generated Content & Feedback

Your Voice Matters — And We Might Share It!

When you send us reviews, photos, or comments (“User Content”), you’re giving Moonlight Safe Rides permission to use that content in our marketing, website, or social media. That means we can share your great feedback (or constructive thoughts) to help others learn about our service.

You promise that any content you share is yours or that you have permission to share it, and that it doesn’t break any laws or copyrights.

Example: If you post a photo from your ride or leave a kind review, we might feature it on our website or Instagram to show others what Moonlight Safe Rides is all about.

15. Driver Classification & Status

Who’s Behind the Wheel?

All Moonlight Safe Rides drivers are independent contractors, not employees or partners. That means while we carefully vet and support our drivers, they work on their own terms and handle their own taxes, insurance, and schedules.

We provide a platform to connect riders with these awesome independent drivers who share our mission of safe, respectful rides.

Example: Think of your driver like a small business owner who chooses to work with Moonlight Safe Rides to provide rides, rather than a salaried employee.

16. Misconduct / Disruptive Behavior

Let’s Keep It Friendly and Safe

Misconduct means any behavior that disrupts the safety, comfort, or respectfulness of the ride. This includes (but isn’t limited to):

  • Harassment, discrimination, or intimidation of drivers or other riders

  • Threatening, violent, or abusive language or gestures

  • Using drugs, smoking, vaping, or drinking alcohol in the vehicle

  • Damaging or defacing the vehicle or driver property

  • Ignoring driver instructions related to safety or rules

  • Bringing more than four passengers without approval

If misconduct happens, the ride may be ended early, and future bookings may be denied.

Example: If someone is being loud, rude, or breaking the no-smoking rule, the driver can end the ride and report the issue to Moonlight Safe Rides.

17. Payments, Refunds & Disputes

Money Matters — Clear and Simple

We authorize your payment method when you book and charge the full amount within 24 hours after your ride ends.

Refunds are only issued if cancellations follow our policies or at our discretion for service issues.

Disputes about charges should be sent to us within 14 days of the ride date. We’ll review and respond promptly.

Shared rides are discounted only if matched; if not, you’ll be charged the standard rate. Refunds for shared rides after confirmation are not available.

Example: Cancel your ride more than 24 hours ahead for a full refund. Cancel within 24 hours, and the ride fee applies.

18. Indemnification & Arbitration

Taking Care of Each Other — Legally Speaking

You agree to protect Moonlight Safe Rides, its drivers, employees, and partners from any claims or damages caused by your violation of these Terms or misuse of the Service.

If a disagreement happens, we agree to resolve it through arbitration in Houston, Texas — a faster, more private process than court. This means no class action lawsuits or public trials.

Example: If you misuse the service and cause damage, you’ll cover costs related to that. If we disagree on something, we’ll handle it privately with an arbitrator instead of a public lawsuit.

19. Regulatory Compliance & Consumer Rights

Following the Rules — Keeping You Protected

Moonlight Safe Rides complies with all applicable Texas transportation laws, safety standards, and consumer protection rules. This means:

  • We respect your rights to cancel rides as outlined.

  • We protect your personal information under our Privacy Policy.

  • We operate with transparency about fares, fees, and driver qualifications.

Example: If weather causes delays or cancellations, we’ll notify you ASAP and follow safety guidelines to keep everyone protected.

20. Governing Law

Which laws apply — just in case

These Terms are governed by the laws of the State of Texas. Any disputes will be handled in accordance with Texas law.

21. Updates

How we’ll keep you in the loop

These Terms may be updated from time to time. We’ll post changes on our website and update the “Last updated” date above. Continued use of our service means you accept the latest version.
